Terms of Service

Dial In ("the app") is a personal memory-training app. These Terms of Service ("Terms") govern your use of the app. By downloading or using Dial In, you agree to these Terms.
Who we are
Dial In is made by Tyler Ferrington, an independent developer based in the United Kingdom. You can reach us at tylerferrington@gmail.com.
What Dial In does
Dial In helps you practice recalling the phone numbers of people already in your device's contacts, through a Game Mode and a Drill Mode. All of your practice history and progress is stored only in the app's local storage on your device — see our Privacy Policy for details.
License to use the app
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Dial In on your own devices for your own personal use. This licence does not give you any ownership of the app itself.
Your responsibilities
- You must be at least 13 years old to use Dial In, or the digital consent age in your country if that age is higher (for example, some EU countries set this at 16).
- You're responsible for the device and contacts you use the app with.
- You agree not to use the app for any unlawful purpose, and not to reverse engineer, decompile, redistribute, or otherwise interfere with the app.
- You agree to comply with all applicable export control and economic sanctions laws in your use of the app.
Acceptable use
Dial In is meant to help you keep in touch with people you already know. You agree not to use it to stalk, harass, or contact someone who has asked you not to, who has blocked or removed you, or who you otherwise don't have a legitimate reason to contact. We may suspend or terminate your access to the app if we reasonably believe you're using it this way.
Your contacts, your responsibility
Dial In reads contact names and phone numbers already stored on your device so you can practice recalling them. It never uploads, syncs, or shares that data with us or anyone else — it stays on your device (see device backups for a note on how your own device backup settings can factor in). Because those contacts didn't choose to be added to your device or this app, you're responsible for making sure you have a reasonable basis for storing and practising with their information, and you agree to indemnify and hold us harmless from any claim, cost, or damage arising from your use of the app in a way that infringes someone else's rights or breaks these Terms.
No warranty
Dial In is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose, to the fullest extent permitted by law. We do not guarantee the app will be uninterrupted, error-free, or compatible with future versions of your device's operating system.
Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the app is limited to the greater of £10 or the amount you paid us for the app in the 12 months before the claim arose (which for most users, given the app is free, is £0). We are not liable for any indirect, incidental, or consequential damages. Nothing in these Terms excludes or limits liability where it would be unlawful to do so — for example, liability for death or personal injury caused by negligence, fraud, or the statutory rights you're entitled to as a consumer under applicable law (such as the UK Consumer Rights Act 2015) that cannot be excluded by agreement.
Third-party platforms
Dial In is distributed through the Apple App Store and/or Google Play. Apple and Google are not parties to these Terms, have no obligation to provide any maintenance or support for the app, and aren't responsible for the app or its content. Those platforms may also collect their own diagnostic or install data under their own privacy policies — that collection isn't controlled by us and isn't covered by this document or our Privacy Policy.
Termination
You may stop using Dial In at any time by deleting the app from your device. We may suspend or withdraw the app, in whole or in part, or terminate your access (including for the acceptable-use reasons above), at any time — though we'll try to give reasonable notice where practical.
Changes to these Terms
We may update these Terms from time to time. Continuing to use Dial In after a change means you accept the updated Terms. The effective date above reflects the latest revision.
Governing law and disputes
These Terms are governed by the laws of England and Wales. You can bring a claim in the courts of England and Wales, or, if applicable local consumer protection law gives you the right to do so, in the courts of the country where you live — nothing here removes any statutory protections you're entitled to as a consumer in your own country.
Before starting any formal claim, you agree to first give us written notice at tylerferrington@gmail.com describing the issue, and to allow us 30 days to investigate and, where appropriate, resolve it.
To the extent permitted by law, any dispute will be resolved on an individual basis, and you agree not to bring or join a class, collective, or representative action against us.
General
If any part of these Terms is found unenforceable, the rest continues to apply. These Terms are the entire agreement between you and us regarding your use of Dial In, replacing any earlier understanding on the subject.
